12 — Consent Agenda

That the following items be approved as presented: 13(b), 13(c), 13(d), 13(e), 14(b), 14(c), 15(b).

13(a) — 2024 Audited Financial Statements

the audited financial statements for the year ended December 31, 2024 be approved.

13(b) — 2024 Final Operations Variance

the final 2024 operating deficit of $1,984,705 be funded by the Investment Income Fluctuation Reserve.

13(c) — April 2025 Budget Variance Forecast

Administration continues to monitor operations and report back to Council with an updated August 2025 variance report.

13(d) — Offer to Purchase - 4th Street, Erieau

The offer to purchase from Ross and Rosemary Newkirk for 0.061 acres and Arthur Vanderpol and Susan O'Brien for 0.062 acres for a combined sale of $90,576

13(e) — Wheatley Legion Grant

That Chatham-Kent Council grant approximately $92,500 from the Strategic Reserve to transfer to the various divisions to offset the Development Charges, Building Permit fees, Planning fees and 2024 and 2025 Property taxes for the Wheatley Legion new building project

14(a) — Parks and Recreation Master Plan Update

14(b) — Essex County Boundary Road Agreement

the Mayor and Clerk be authorized to execute a boundary road agreement with The Corporation of the County of Essex

Traffic and Parking By-law Amendment be approved as listed and attached in Appendix A.

15(a) — Encampment Protocol - Reconsider Aug 11 Setbacks

the following amendments to the Municipal Encampment Protocol from the August 11, 2025 Council Meeting be reconsidered

15(a) — Encampment Protocol - Reduce Setbacks to 25m + PUC Site Exemptions

reduce the set back of 100 metres from a habitable residence or business, with a set back of 25 metres from a habitable residence or business.

15(a) — Encampment Response Protocol By-law + Enforcement Contract

By-law enforcement services for the Encampment Response Protocol be single-sourced to Royal Protective Services, at a total value not to exceed $238,882, including HST

15(c) — Treatment Facility & Supportive Housing / HART Hub

That Chatham-Kent Council direct Staff to investigate and present options for establishing partnerships with treatment facilities to reduce the time between detox and admission into recovery/treatment programs.

16(a) — Waive Notice - Harrigan Wheatley Insurance Motion

That Council waive notice to allow a motion by Councillor Harrigan to be voted on at this meeting.

16(a) — Wheatley Class Action - Waive Insurance Deductible Recuperation

the Municipality of Chatham-Kent waives the recuperation of its $250,000 insurance deductible pertaining to the Wheatley Class Action Lawsuit.

That the by-laws be taken as read for a first time.
